Ahh, so you are admitting he prefers to be alive... If the Government genuinely attempts to catch the real culprits, and is reasonably good at convicting them, there will be no recidivism for one thing. I have always assumed that life in prison is a disincentive, and death is greater, but not worth executing an innocent person. Only if the people don't know about it. They wouldn't trust the justice system, and if they could get executed for anything, why not commit crimes they have always wanted to but had the self control not to? Doesn't this say more about utilitarianism than me? As for the four crimes I list, the results of them being successfully carried out are worse than a single murder. I see the chances of an accused being innocent as a lot lower (virtully zero), the evidence less ambiguous and if they are innocent, a greater chance for them to be set free (almost certain), if their legal definitions are not abused. Would you feel the need to defy a legitimate Government that respects your rights? GRIII and an arpeitheid regeiem are a "tad" different in many ways.
