No government thinks itself illegitimate. It is easy to exclude examples of things that are obviously wrong in hindsight... but such things are very rarely obviously wrong when you know all the facts, and generally hindsight isn't available until after the fact.

As for guilt being easier to tell when you commit a crime against the government - I must say that my presumption is the exact opposite. If I was told that a court found one person guilty of murder and another person guilty of a political crime, I would be more skeptical about the nature of the second crime. I guess that's why people generally object to people being punished as 'political prisoners'.

As an aside, I don't know of any government in the world right now that will respect my rights. That said, I'm not about to start a violent revolution. :)

I agree with your point about it being necessary for the innocent soon-to-be-killed dealth-penalty patsy to look guilty to the general populace.
