No Oz never did give nothin' to the "Strawman" that he didn't, didn't already have!
The insurance companies, or property protection agencies, would also have an interest in agreeing in advance on judges or arbiters that would deliver efficient (private) Common Law remedies to insured parties who were claiming damages, whether caused by fire or anything else.
We could go a bit further and say the property protection agencies would have a financial interest in optimizing the risk of damage from fire (say, by financing more back-burning), or from an attack by Iraqi terrorists (say, by knocking off Saddam). And if the consumer disagreed, he would just need to find an agent who shared his risk assessment.
