In a world of scarcity, everything that is used is effectively owned (ie somebody has control and can exclude other people of use). Ownership is not a negative or positive right -- it is a necessarily element of human interaction. Somebody (or some entity) has to determine how things get used. This is true for every political system (or at least any political system that where people interact and use things). If you currently have legitimate control of some property, then there are only two ways that somebody else can gain control. Voluntarily or through violence/coercion. A negative right is a freedom from violence. A 'positive' right is the right to use violence. The problem with your argument is that it assumes you have the "liberty to use that item". Where did that right come from? Do you have the 'right' to use my body (you sick bastard)? :) Your 'right' to use anything anytime you want is most definitely not a negative right!
