They have been put in jail through a legal procedure - just not the same one which the US uses for its own citizens. That was my point. The US is not going to put up with Osama bin Laden walking free from a US courtroom because of some bizarre technicality based on a 200 year old precedent about lubricated goats with mobile phones or some such.
