The only hope for claimants from Vietnam is to get in front of a "lefty Federal Court judge". The UNHCR has ruled Vietnam to not be a place from which refuge can be sought.
Funnily enough, virtually all Vietnamese nationals granted asylum in Australia return to Vietnam at some stage, and aren't thrown into a cage in a paddyfield and poked with sticks. (After the Tiannamen Square debacle, when Blubbering Bob opened the gates to 80,000 Chinese on "student" visas, DIMEA did a survey on those with protection visas, and all of them returned (to visit) China within 6 months of Tiannamen Square.) Seems some folks have a different view of persecution to me.
